Notice of the China (Shanghai) Pilot Free Trade Zone on the Examination and Approval of the Pre-examination of Construction Project Land

Operation Basis

Laws: Article 52 of the Land Administration Law of the People’s Republic of China sets forth: In the process of the feasibility study for construction projects, land administrative departments may examine related matters concerning land for construction purposes and put forward their proposals according to the general plans for the utilization of land, the annual plan for the use of land and standards for land used for construction purposes.

Local Regulations: Article 29 of the Measures of Shanghai for Implementation of the Land Administration Law of the People’s Republic of China provides for: The construction unit shall, upon research and consideration of the feasibility of the construction projects, file a pre-application for construction land at the land administration authority at the municipal or district (county) level. The land administration authority at the municipal or district (county) level shall, within 15 days from the day upon acceptance of the pre-application for construction land, examine the issues relating to land for construction projects and file a pre-approval report according to the overall plan on use of land and annual plan on use of land. Upon report of the Construction Project Feasibility Research Report for approval, the report on pre-approval of land for construction projects as issued by the land administration authority at the municipal or district (county) level shall be attached.
