Nansha to hire Hong Kong and Macao labor and personnel dispute arbitrators

On Feb 19,Nansha Labor and Personnel Dispute Arbitration Commission approved the appointment of Hong Kong and Macao persons as arbitrators of labor and personnel disputes by the Ministry of Humanities and Social Sciences, coincident with the official announcement of the Guangdong-Hong Kong-Macao Greater Bay Area Development Plan.

Nansha is the first area in the country to explore the appointment of Hong Kong and Macao labor and personnel dispute arbitrators, which will facilitate the direct participation of Hong Kong and Macao residents in the development of Chinese mainland, making Hong Kong and Macao people the 'builders' of the rule of law in Guangdong-Hong Kong-Macao Greater Bay Area. This also has great impact on implementing the basic national policy of 'one country, two systems'.

Labor dispute arbitration as a quasi-judicial act, provides labor arbitration services for Guangdong, Hong Kong and Macao trade. It strengthens judicial exchanges and cooperation among Guangdong, Hong Kong and Macao, and promotes the establishment of a multiple dispute resolution mechanism for consultation, co-construction and sharing. It provides high-quality, efficient and convenient judicial services and guarantees for Guangdong-Hong Kong-Macao Greater Bay Area.

The total number of Hong Kong and Macao enterprises in Nansha increased by 113 percent year-on-year in 2018, accompanied by a series of problems such as difficulties in the delivery of labor disputes, cross-regional investigations, and communication mediation in Hong Kong and Macao cases.

"This will help Nansha absorb the rules of dealing with the labor disputes in Hong Kong and Macao and gradually make Hong Kong and Macao more aware of the labor dispute handling system in the Mainland,"Professor Zhou Xianri, president of the Social Law Research Association of the Guangdong Law Society said.

In accordance with the relevant principles, Nansha plans to implement it step by step within three years, and strives to build a training base for the country's Hong Kong and Macao arbitrators to form innovative experiences.

"The management of Hong Kong and Macao arbitrators will basically take the same principle with others, including the pre-employment training and examinations. After obtaining the arbitrator's certificate, the Nansha Arbitration Commission appoints the Hong Kong and Macaopersons as part-time arbitrators.
