After foreign talents have obtained work permits, residence permits, and signed labor contracts, they can be deemed to have established labor relationship and can be legally employed in China, and are protected by the relevant laws of PRC. When labor disputes arise, they shall fall within the scope of labor arbitration. Foreign talents who work for the employer without work permits are illegally employed. The two parties have not established a labor relationship and are not protected by labor laws and regulations of PRC. If the two parties have disputes, they are not within the scope of labor arbitration.
